Terms and Conditions

The following Terms and Conditions shall apply to any USER who uses Indus Group (www.1indus.com). All the conditions are deemed to be fully read, understood and accepted by the USER(s)

Definitions:

In these Conditions the following words and phrases shall have the following meanings unless the context requires otherwise:
Advertisement: any Advertisement issued by Indus Group on behalf of the Client. Applicant: a Candidate who applies for a vacancy advertised on www.1indus.com. Candidate: a person who uses the Indus Group for the purpose of finding employment. Client: the person(s) who have signed a Service Agreement for use of the Indus Group Services. Resume: the curriculum vitae or brief outline details of a Candidate's education, training, skills and employment experience which is provided to Indus Group by a Candidate for distribution to Clients with a view to securing employment. Services: the Services which Indus Group has agreed to provide to the Client and the Services which are available on the Indus Group for use by Candidates.

Services Generally:

Indus Group does not make any representation whatever about any Advertisement accessed either on, by virtue of or by way of any links from the Indus Group not about any of the Clients who use Services on the www.1indus.com. Indus Group relies on information provided to it by Clients and via third parties and accordingly it is a matter for the Candidate to satisfy itself as to the suitability of any Client using Services on Indus Group or of any Advertisement found directly or indirectly through the www.1indus.com. Indus Group s hall be entitled at anytime without notifying the Candidate to make changes to the Services which are necessary to comply with any applicable security or other statutory requirements and shall determine the manner in which the Services are provided. Any intellectual property, ideas, concepts, know-how or techniques developed by or obtained during the execution of the Services will be owned exclusively by www.1indus.com.
Indus Group shall not be responsible for any failure to provide the Services, or unavailability of the www.1indus.com, as a result of circumstances beyond its reasonable control. The Candidate agrees to provide www.1indus.com, in such a format as Indus Group may request, any information necessary to enable Indus Group to provide those Services. Indus Group shall not be obliged to provide those Services until the Candidate has supplied it with the information, necessary to provide those Services.

Resume's:

If the Candidate has saved their details and stored a Resume on www.1indus.com, the provisions of this clause shall apply thereto. Indus Group will only make available or supply copies of the Resumes which have been received by it for distribution to Clients of Indus Group solely for the purpose of securing suitable employment for the Candidate. Indus Group cannot guarantee the minimum number of times a Resume will be viewed by or distributed to Clients on any given day.

Indus Group has the right at its sole discretion to decline to distribute or forward, or to suspend or remove any Candidate information or Resume accepted by it. Indus Group may refuse, withdraw, or require to be amended, any Candidate information or Resume which is illegal, immoral, obscene or offensive or so as to comply with the legal or moral obligations placed upon Indus Group or the Candidate or to avoid infringing a third party's rights or any statutory or regulatory requirements or is designed to or is likely to cause disruption to any computer system or network.

Account Registration:

In order to access certain features of the Site and Application, and to create a resume to apply to job advertisements, you must register to create an account (“Indus Group Candidate Account”) and become a Member. You may register to join the Services directly via the Site or Application or as described in this section. You can also register to join by logging into your account with certain third party social networking sites (“SNS”) (including, but not limited to, Facebook and LinkedIn); each such account, a “Third Party Account”, via our Site or Application, as described below. As part of the functionality of the Site, Application and Services, you may link your Indus Group Account with Third Party Accounts, by either: (i) providing your Third Party Account login information to Indus Group through the Site, Services or Application; or (ii) allowing Indus Group to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account. You represent that you are entitled to disclose your Third Party Account login information to Indus Group and/or grant Indus Group access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating Indus Group to pay any fees or making Indus Group subject to any usage limitations imposed by such third party service providers. By granting Indus Group access to any Third Party Accounts, you understand that Indus Group will access, make available and store (if applicable) any Content that you have provided to and stored in your Third Party Account (“SNS Content”) so that it is available on and through the Site, Services and Application via your Indus Group Account and Indus Group Account profile page. Unless otherwise specified in these Terms, all SNS Content, if any, will be considered to be Member Content for all purposes of these Terms. Depending on the Third Party Accounts you choose and subject to the privacy settings that you have set in such Third Party Accounts, personally identifiable information that you post to your Third Party Accounts will be available on and through your Indus Group Account on the Site, Services and Application. Please note that if a Third Party Account or associated service becomes unavailable or Indus Group’s access to such Third Party Account is terminated by the third party service provider, then certain SNS Content will no longer be available on and through the Site, Services and Application. You have the ability to disable the connection between your Indus Group Account and your Third Party Accounts, at any time, by accessing the “Settings” section of the Third Party Accounts. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT WITH SUCH THIRD PARTY SERVICE PROVIDERS. Indus Group makes no effort to review any SNS Content for any purpose, including but not limited to, for accuracy, legality or non-infringement and Indus Group is not responsible for any SNS Content.

We will create your Indus Group Account and your Indus Group Account profile page for your use of the Site and Application based upon the personal information you provide to us or that we obtain via an SNS as described above. You may not have more than one (1) active Indus Group Account (but you may have multiple resume´s). You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. Indus Group reserves the right to suspend or terminate your Indus Group Account and your access to the Site, Application and Services if you try to impersonate an existing Indus Group Account or if any information provided during the registration process or thereafter proves to be inaccurate.

The Candidate hereby understands that:

the details and Resume they store and save on Indus Group are true and accurate reflections of their education, employment, training history and that their personal details are correct. That if any of the information stored and saved on Indus Group for the purposes of securing employment is found to be false or inaccurate in any way, that Indus Group reserves the right to remove those details and/or suspend the use of the Services on the Indus Group for the Candidate.

Applications and Application Forms:

If the Candidate makes an Application or is required to complete an Application Form as part of an Application, the provisions of this clause shall apply thereto.

The Candidate hereby understands that:

• They have fully read and understood the requirements of a vacancy Advertisement on the Indus Group to which they make an Application
• they have the appropriate skills and qualifications required by the Client
• the details they provide to the Client as part of an Application or in an Application Form are a true and accurate reflection of their education, employment, training history and that their personal details are correct
• that if any of the information used in an Application or Application Form is found to be false or inaccurate in any way, that Indus Group reserves the right to remove those details and/or suspend the use of the Services on Indus Group for the Candidate

Indus Group may refuse, withdraw, or require to be amended, any Application which is illegal, immoral, obscene or offensive or so as to comply with the legal or moral obligations placed upon Indus Group or the Candidate or to avoid infringing a third party's rights or any statutory or regulatory requirements or is designed to or is likely to cause disruption to any computer system or network. When a Candidate makes an Application, Indus Group will pass the Candidate's details to the Client who placed the Advertisement for the purpose of that one Application only. The Candidate accepts that Indus Group cannot be held responsible for the content of Advertisements on the Indus Group and that no obligations are imposed on Indus Group in this regard.

Liability

Indus Group will not be liable (whether in contract or tort) for:

• any loss of data, Resumes or other materials that the Candidate supplies to www.1indus.com
• any mistakes or errors whatsoever that arise during the course of use of the Services or any loss of information or data or any damage thereto in each case as a result of circumstances beyond its reasonable control or which arise as a result of the acts or omissions of the Candidate
• for any failure to secure employment or consequential loss (whether caused by the negligence of www.1indus.com, its employees or agents)
• any delay, costs, expense, loss, damage or liability (including without limitation as a result of any use of software, virus, deletion, corruption, loss or removal of data) howsoever caused arising from any matter beyond the reasonable control of Indus Group or as a result of the acts or omissions of the Candidate
• Any loss or damage whatsoever howsoever caused arising out of the negligence, dishonesty, misconduct, breach of faith, incompetence, or the wrongful disclosure of confidential information by, any Client. It is for the Candidate to satisfy itself as to the integrity and reliability of all vacancy Advertisements placed on the www.1indus.com
• any breach of agreement or infringement or violation of any right of any person or be rendered liable to any proceedings whatsoever, as a result of any information or Resume or Application submitted to it by the Candidate and the Candidate identifies Indus Group against all costs, claims, damages, loss, expenses and liabilities suffered or incurred by Indus Group as a result of this undertaking and warranty being incorrect.

The Candidate agrees and acknowledges that no condition, warranty or representation of any kind is, has been, or will be, given by or on behalf of Indus Group in respect of or in connection with the Services and accordingly the Candidate confirms that it has not, in accepting these Conditions, relied on any condition, warranty or representation by Indus Group or any person on its behalf, express or implied, whether arising by law or otherwise in relation to or in connection with the Services. The benefit of any such condition, warranty or representation by Indus Group is hereby irrevocably and unconditionally waived by the Candidate.

Termination and Cancellation

These Conditions apply unless replaced by subsequent Conditions. The Candidate shall be responsible for all reasonable costs, claims, damages, loss, expenses and liabilities incurred by Indus Group arising out of the Candidate's breach of its obligations under these Conditions (including, without limitation, on a solicitor and own client basis, any legal fees and disbursements reasonably incurred by www.1indus.com).

General

If any provision of these Conditions shall be invalid or unenforceable, it shall not affect any other provision, which shall remain in full force and effect.

Any waiver by Indus Group of any breach of, or any default under, any provision of these Conditions by the Candidate will not be deemed to be a waiver of any subsequent breach or default and will in no way affect the other terms of these Conditions. Failure or delay by Indus Group in enforcing or partially enforcing any provision of these Conditions will not be construed as a waiver of any of its rights under these Conditions.

Law

These Conditions and any contract, into which these Conditions are incorporated, shall be governed by and construed in accordance with Indian law.
